Welcome to Jasmine Uhrik. The terms "we", "us" and "our" refer to Jasmine Uhrik, a London-based artist trading through www.jasmineuhrik.com (the "Site"). We operate the Site and offer original paintings, prints, and related products and services (together, the "Services").

These Terms of Service ("Terms"), together with our Privacy Policy, Returns Policy, and Shipping Policy, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access the Services.

1. Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old (or the age of majority where you live) and that you have the legal capacity to enter into a binding contract.

To place an order, browse, or contact us, you may be asked to provide certain information, such as your name, email address, billing, payment, and shipping details. You represent and warrant that all information you provide is true, current, complete, and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, or assign your account to anyone else.

2. Our products

We make every effort to represent our artworks and products accurately on the Site. Please note, however, that colours, texture, and surface detail may appear differently on your screen depending on your device and display settings. Originals in particular are handmade, one-of-a-kind works and may have slight variations from the photographs shown.

All descriptions, specifications, and prices may change at any time without notice, at our discretion. We reserve the right to discontinue any product, limit quantities, or refuse orders, including on a per-person, geographic region, or jurisdiction basis.

3. Orders

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance, typically when we dispatch the artwork. We reserve the right to accept or decline any order for any reason, including if the item is no longer available, if we identify an error in the price or product description, or if we are unable to authorise payment.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order is accepted and processed. If we cannot accept, change, or need to cancel an order, we will contact you by email or phone using the details provided at the time of order, and refund any amounts already charged.

Your right to cancel an order and return items is set out in our Returns Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices on the Site are shown in Great British Pounds (GBP) unless otherwise stated. The price charged for a product will be the price in effect at the time your order is placed and will be confirmed in your order confirmation email.

Unless stated otherwise, posted prices do not include shipping, handling, customs duties, or import VAT that may apply to international orders. These will be shown separately at checkout (for shipping) or charged by the destination country (for duties and import VAT on international orders).

You agree to provide current, complete, and accurate payment and contact information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorised to use the payment method, and (iii) you will pay the charges incurred, including shipping and handling charges and any applicable taxes.

5. Shipping and delivery

Shipping, delivery times, packaging, and customs are described in our Shipping Policy. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or other events outside our reasonable control. Once a parcel is handed to the carrier, title passes to you; all shipments are fully insured against loss and damage in transit.

6. Intellectual property

All artwork, images, text, layout, branding, and other content on the Site, and all original artworks and prints we sell, are protected by copyright and other intellectual property rights and are owned by Jasmine Uhrik unless otherwise stated. All rights are reserved.

Purchasing an original artwork or print gives you ownership of the physical piece you purchased. It does not transfer any copyright or reproduction rights. You may not reproduce, copy, scan, photograph for commercial use, create derivative works from, or otherwise exploit the artwork or any content on the Site without our prior written consent.

These Terms permit you to use the Site for your personal, non-commercial use only. "Jasmine Uhrik" and related names, logos, designs, and slogans are trademarks of Jasmine Uhrik. You may not use them without prior written permission.

7. Third-party platforms and tools

The Site may be powered or supported by third-party platforms (for example, our e-commerce platform, payment processors, email tools, and analytics providers). Your use of any third-party tool or service is entirely at your own risk and subject to the terms and privacy policy of that third party. We provide access to any such tools "as is" and without any warranty, and we have no liability for your use of them.

8. Third-party links

The Services may contain links to websites operated by third parties (for example, social media platforms or external references). We are not responsible for the content, accuracy, practices, or privacy policies of those third-party websites. If you choose to follow a link and leave the Site, you do so at your own risk.

All personal information we collect through the Services is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

10. Feedback

If you send us ideas, suggestions, reviews, feedback, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, and publish that Feedback in any medium, including for marketing purposes. You confirm that you own or have the rights to all Feedback you send us, that it is accurate, and that it does not infringe any third-party rights. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

11. Errors, inaccuracies and omissions

Occasionally the Site may contain typographical errors, inaccuracies, or omissions, including regarding product descriptions, prices, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors, update information, and cancel orders if any information on the Site is inaccurate — including after you have submitted your order.

12. Prohibited uses

You may access and use the Services for lawful purposes only. You must not use the Services:

For any unlawful or malicious purpose or in breach of any applicable law or regulation.
To infringe our intellectual property rights or those of any third party.
To harass, abuse, defame, or intimidate any person, including our staff, suppliers or customers.
To submit false or misleading information.
To send spam, chain letters, phishing messages, or other unsolicited communications.
To upload viruses, malicious code, or any technology that could damage the Services.
To reproduce, duplicate, copy, resell, or commercially exploit any part of the Services without our written permission.
To collect or track the personal information of others, or to scrape, crawl, or otherwise extract content from the Site in an automated way.
To circumvent the security features of the Services or any related site.

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if we believe you have breached these Terms.

13. Termination

We may terminate this agreement or your access to the Services (or any part of them), in our sole discretion, at any time and without notice, if you breach these Terms or for other legitimate reasons. Termination does not affect your liability for any amounts due up to and including the date of termination.

The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Entire Agreement, Assignment, Governing Law, Privacy, and any other provision that by its nature should survive termination.

14. Disclaimer of warranties

The information presented on the Site is provided for general information only. We do not warrant that the Site will always be available, uninterrupted, timely, secure, or free of errors. Any reliance you place on information on the Site is strictly at your own risk.

Except as expressly provided by Jasmine Uhrik and except for your statutory rights as a consumer that cannot be excluded or limited, the Services and all products offered through the Services are provided on an "as is" and "as available" basis, without representation, warranty, or condition of any kind, whether express or implied.

15. Limitation of liability

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable consumer protection law; or (d) any other liability that cannot be excluded or limited under the laws of England and Wales.

Subject to the above, to the fullest extent permitted by law, our total liability to you in connection with the Services or any product purchased through the Services will not exceed the amount you paid for the relevant product. We will not be liable for any indirect, special, incidental, punitive, or consequential losses, including loss of profits, revenue, savings, data, or goodwill, even if we have been advised of the possibility of such losses.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Jasmine Uhrik from and against any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of (i) your breach of these Terms or any policy referenced in them, (ii) your violation of any law or the rights of a third party, or (iii) your access to and use of the Services. We will notify you promptly of any claim and will not settle any claim that imposes non-monetary obligations on you without your consent (not to be unreasonably withheld). You will cooperate in the defence of any indemnified claim.

17. Severability

If any provision of these Terms is held by a court to be unlawful, void, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms. The remaining provisions will continue in full force and effect.

18. Waiver and entire agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, Returns Policy, and Shipping Policy, constitute the entire agreement between you and Jasmine Uhrik regarding your use of the Services and supersede any prior or contemporaneous agreements between us.

19. Assignment

You may not assign, transfer, or delegate these Terms or any of your rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

20. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, although as a consumer you may have additional rights to bring proceedings in the country where you live.

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates on the Site. Material changes will be notified in accordance with applicable law and will apply from the date they are posted or as otherwise specified. Your continued use of the Services after changes are posted constitutes your acceptance of those changes.
